The Indiana Court of Appeals has affirmed the attempted murder conviction of a Gary man who shot his younger brother in their elderly mother's house during a dispute over her care arrangements.
Michael Smith, 67, is serving a 32-year sentence for the Aug. 4, 2021, non-fatal shooting of Alphonzo Smith after Alphonzo Smith told Michael Smith he'd moved their mother from her Gary home to an assisted living facility, according to court records.
Records show Alphonzo Smith; Larry Harris, Smith's friend; and a repairman set to work at the residence all witnessed Michael Smith shoot his brother after entering their mother's home. Each witness also simultaneously called 911 immediately after the shooting to report it.
Police and paramedics quickly arrived at the home. Alphonzo S
