LaPorte County is asking state regulators to reject NIPSCO's proposed GenCo spinoff and require the Merrillville-based utility to continue to go through the established regulatory process when bringing new power generation online to serve new data centers.

The county filed a proposed order on behalf of stakeholders that would reject NIPSCO's plans to create a first-in-the-nation spinoff that would negotiate rates directly with megaload data center customers and instead require it to go through the normal public hearing process in order to get rates approved.

NIPSCO argues that a separate company meeting the rapid demand for data centers would protect current customers from the cost and risk of developing or acquiring new electric generation capacity. It contends that a lightly regulated
