A man being held at the Federal Correctional Institution in Otisville was convicted of murdering another man being held there, the U.S. Attorney's Office for the Southern District of New York announced Aug. 15.
A jury found Daniel V. Smith, 65, guilty of first-degree murder, a felony, in a trial before U.S. District Judge Philip M. Halpern.
According to the indictment against Smith, court filings and statements made in court, Smith was serving a sentence for assault, which he allegedly committed while incarcerated in 2013.
On Oct. 26, 2021, Smith, who wanted a transfer to a different housing unit, without provocation brutally attacked another inmate, housed in the cell next to his own by swinging a lock tied to a belt and striking his victim in the head repeatedly, cracking his skull.
