Boston Marathon bomber Dzhokhar Tsarnaev’s lawyers on Thursday asked the full First Circuit Court of Appeals to reconsider a bid to remove the judge overseeing an investigation into potential juror bias in his 2015 trial.

A smaller, three-judge panel rejected the bid last month. The defense is now seeking an en banc rehearing, meaning all active First Circuit judges would revisit the decision.

The outcome of the juror-bias investigation could affect Tsarnaev’s sentence, potentially leading to a new trial to determine whether he remains on death row or receives life in prison.
