STATEWIDE -- The Maine Supreme Judicial Court rejected the appeal of a man convicted of aggravated assault and other charges after hitting and severely injuring an elderly man in brewer.
In July 2023, David MacKenzie left a Brewer bar intoxicated after drinking 12 22-ounce beers over the course of six hours, and while driving, hit and injured an 87 year-old man. MacKenzie was found guilty of aggravated criminal OUI, aggravated assault, and leaving the scene of an accident involving serious bodily injury or death.
He was later convicted on all charges but appealed his conviction, arguing that the court should not have admitted into evidence the expert testimony of a state chemist about his estimated blood alcohol concentration and that there was insufficient evidence to convict him of the
