The maker of the plushy Squishmallows is looking to dismiss its lawsuit against Build-A-Bear Workshop.

Last year, California-based Kelly Toys Holdings and its affiliate companies sued Build-A-Bear over alleged infringement of trade dress rights, claiming that Build-A-Bear’s plush line, called Skoosherz, is too similar to its own brand of cute, round character-like pillow toys, Squishmallows.

Kelly Toys Holdings’ suit, filed in California, argues that Skoosherz toys have the same distinctive trade dress as Squishmallows, such as shaped fanciful renditions of animals and characters, simplified Asian-style Kawaii faces, embroidered facial features, non-monochrome coloring and a velvety velour-like textured exterior.
