According to the New York Times, federal prosecutors in Washington were unable on Tuesday to convince a grand jury to indict a man on felony assault charges after he allegedly threw a sandwich at a federal agent earlier this month, according to sources familiar with the case.

The defendant, Sean C. Dunn, 37, a former Justice Department paralegal, was arrested on August 13 following the incident near 14th and U Streets, a busy nightlife district in the city. Authorities say Dunn confronted a Customs and Border Protection officer, called the agents “fascists,” and shouted “I don’t want you in my city!” before tossing a submarine sandwich at the officer.
