The attorney representing the suspended Atlantic City High School principal, who is accused of failing to report the alleged abuse of the mayor and superintendent's daughter, is seeking to have the appellate court hear a Superior Court judge's decision rejecting a motion to dismiss the case against her.
Constance Days-Chapman is charged with official misconduct, pattern of official misconduct, endangering the welfare of a child and hindering apprehension. She is due back in court Sept. 29 for a pretrial conference. She has pleaded not guilty.
Judge Bernard DeLury rejected the motion to dismiss July 9 and refused to reconsider his decision Aug. 6.
