(NewsNation) — Riverside County District Attorney Mike Hestrin lambasted a judge over a decision that kept missing 7-month-old Emmanuel Haro's father out of prison.
The father, Jake Haro, was given a suspended sentence in 2018 for a separate child abuse case, allowing him to avoid prison.
"If that judge had done his job … Emmanuel would be alive today," Hestrin said.
Riverside County Sheriff Chad Bianco echoed the sentiment, saying the baby's death was "preventable in numerous ways."
The parents of baby Emmanuel, Rebecca and Jake Haro, were charged with the murder of their son Tuesday. They were also charged with filing a false police report.
