MOBILE, Ala. ( WALA ) - A wrongful-death lawsuit that has been brewing for more than a decade finally is set to go to trial Monday.

Filed by the family of a Louisiana man, the suit alleges that that a Baldwin County sheriff’s deputy was unjustified in shooting the unarmed man after a chase on Interstate 10 in 2017. The case has been back and forth through the federal appeals court, and it also generated a landmark ruling by the Alabama Supreme Court in 2021 that law enforcement body camera footage is not subject to the state’s open records law.

Within days of the shooting in May 2017, then-Baldwin County Sheriff Huey “Hoss” Mack was defending Cpl. Matthew Hunady. The sheriff acknowledged that Jonathan Victor did not have a gun but said two objects were in his hands.
