A new trial has been ordered for a Pitt Meadows man accused of possessing child pornography.
The Crown successfully appealed the acquittal of a charge of possession of child exploitation material, against Eric David Guenter, the B.C. Court of Appeal decided on Sept. 5.
His acquittal was the result of a ruling by the trial judge in July 2023 that the warrant authorizing a search of Guenter's residence infringed on the accused's rights under the Charter of Rights and Freedoms. The judge in the case said the warrant did not show reasonable grounds to believe the evidence would be at Guenter's home. So the images found at his home were excluded from the trial, and the Crown was left without evidence to support the charge.
