MEMPHIS, Tenn. — One of the former Memphis Police Department officers charged in the death of Tyré Nichols, Tadarrius Bean, filed a motion to have his bail status reinstated on Tuesday.

In the motion, Bean's counsel asked the United States District Court to allow Bean's release without travel restrictions, citing his consistency in meeting all court-ordered requirements without issue.

He, along with Demetrius Haley and Justin Smith, will receive a new trial following the recusal of federal judge Mark S. Norris. A hearing on the motion has been scheduled for Sept. 17 at 2 p.m. before Magistrate Judge Charmiane G. Claxton.

Motions were previously granted for the three former officers to have another trial due to communications from the former judge over the case surrounding the Memphis
