A state judge has agreed not to send Abita Springs Mayor Dan Curtis to jail after Curtis' lawyers raised concerns about Curtis' upcoming back surgery.
Judge William Burris of the 22nd Judicial District on Monday had ordered Curtis to spend weekends in jail in a ruling stemming from a long-running dispute between the town of Abita Springs and a developer that wants to build a new subdivision.
But Burris granted a request from Curtis to place a stay on his order after Curtis' lawyers raised concerns about Curtis' medical condition, Curtis' lawyer Andrew Wilson said on Thursday.
Curtis is suffering from "severe spinal degeneration," and plans to undergo spinal fusion surgery later this month, Curtis' lawyers said, citing an affidavit from Curtis' doctor. Sending him to jail at this junct
