A Harker Heights man who already is set to have a capital murder case decided by a jury later this month also is fighting an arson charge after being accused of setting a fire in his jail cell.

Jerry Wayne Baker, 41, was booked into the Bell County Jail on Oct. 2, 2020, the day after he allegedly shot and killed 35-year-old Michael Angelo David and David’s mother, 55-year-old Gina David Kearney, at David’s Heights home.

Baker was indicted by a Bell County grand jury on Dec. 9, 2020, on a charge of capital murder of multiple persons. He then was indicted on Aug. 27, on a first-degree felony charge of arson with intent to damage a habitation. The public grand jury report did not list his name among the indictments.
