The family of a Bronx man who hanged himself on Rikers Island the day after he was arraigned for shooting to death the superintendent of his building have filed a legal motion to force the city to turn over documents connected with the suspect’s death, court records show.

Murder suspect Jimmy Avila’s brother is a Correction Department captain who was working in the jail unit where Avila was being held when he died, his family says.

Relatives of Avila, 44, are now seeking a judge’s order requiring the city to fork over records and preserve evidence related to Avila’s apparent suicide on Aug. 30 in the West Facility on Rikers Island , court records show. Avila had been in the jail less than 24 hours when he died.
