FAYETTEVILLE, N.Y. (WSYR-TV) -- We have an update to a story we've been following for years about a proposed grocery store coming to Fayetteville.
The plan to transform the old O’Brien & Gere manufacturing site on E. Genesee Street into a 56,000 sq. ft. supermarket was approved by the Village of Fayetteville Planning Board back in 2022.
The project has not been able to move forward due to two lawsuits, brought by Fayetteville resident Marguerite Ross, who opposed the development.
In a decision released on Thursday, the New York Court of Appeals declined to take up Ross' case, leaving the decision in the Village's favor.
This decision means that both lawsuits have been resolved. Currently, there's no pending litigation on the matter, according to Ross's attorney, Jonathan Tantillo.
"We
