The lawsuit against the city of Killeen over the marijuana decriminalization ordinance passed by voters in 2022 will be returning to local district court since the appellate process has run out of track with the Texas Supreme Court’s refusal to hear the case.
“We were not surprised by their decision,” said Bell County Attorney James Nichols, who spoke with the Herald on Friday regarding the higher court’s decision to not grant the city’s request to review an April ruling by justices in Austin. “It’s rare for the Supreme Court to take up a petition for review in this situation.”
