A Tulsa County District Court judge didn’t abuse his discretion when he determined a Tulsa man to be actually innocent of rape and other crimes, the Oklahoma Court of Criminal Appeals ruled Monday.

The ruling shot down an appeal by Tulsa County District Attorney Steve Kunzweiler, who had challenged District Judge David Guten’s actual innocence finding for William Henry Jamerson.

In July 2024, Guten overturned Jamerson’s convictions on first-degree rape, first-degree robbery and rape by instrumentation after the victim recanted and DNA evidence that had been stored for years but only recently tested excluded Jamerson as a contributor of the DNA linked to the rape.
