NELSON, Neb. (KSNB) - The attorney representing a Superior man convicted of murdering his girlfriend has explained in writing why he thinks there should be a new trial.
On June 30, a Nuckolls County jury convicted 32-year-old Sebastian Dunbar of murder for the December 2023 shooting death of Molly Gruber.
Court documents show that the next day, prosecutors told Dunbar’s attorney that they had obtained new evidence from Gruber’s cell phone. Investigators had Gruber’s phone since her murder in 2023, but court documents show they had been unable to crack the phone until June 30, the day Dunbar was convicted.
In his brief arguing for the new trial, Dunbar’s attorney claims that the cell phone contains evidence related to drug use by Gruber, as well as new evidence about Gruber’s mental s
