LAS VEGAS ( FOX5 ) — A Clark County District Court judge has been suspended for over a year without pay, documents say.
According to documents, Erika Ballou ordered a woman to be released from custody after the defendant claimed ineffective assistance of counsel for a felony offense in 2017. The State of Nevada appealed, and in 2022, the Nevada Supreme Court reversed Ballou’s decision, claiming the defendant’s finding had no support.
Documents said Ballou did not enter an order denying the woman’s petition, but instead allowed her the opportunity to present more evidence. In 2023, the State of Nevada filed a petition for an order directing Ballou to cancel the evidentiary hearing and rule in favor of the state. The defendant would be placed in custody.
Ballou is accused of not followi
