A man accused of strangling his 8-month-old sister in Virginia last week received a deportation order, authorities say.

The 8-month-old girl was attacked on Sept. 17 and died on Tuesday, police said. She was found with a white charging cord around her neck, according to police. The baby’s brother, Alvaro Mejia Ayala, 22, is in custody, and federal immigration authorities say he was in the country unlawfully.

"Let me be clear, this was not an accident," Leesburg Police Chief Thea Pirnat said with anguish.

The baby was found in the family’s home on Hancock Place NE in Leesburg and was rushed to a hospital in critical condition. Mejia Ayala took off before officers arrived, police said.
