CORTEZ, Fla. (WWSB) - A Cortez man accused of starting a gunfight that wounded his girlfriend and himself during a domestic dispute has asked a judge to dismiss the charges under Florida’s “Stand Your Ground” law, court records show.
Keven Anderson says he was threatened with death and confronted by armed men on his property in the June 6 incident.
“The defendant was justified in using force where he reasonably believed that such conduct was necessary to prevent bodily harm to himself and/or he had no ability to retreat under the circumstances,” the motion to dismiss the charges, filed Sept. 16, said.
Armstrong is facing three counts of aggravated assault with a deadly weapon.
