SEATTLE, Wash. – A federal judge has dismissed the lawsuit against Seattle's iconic alternative band Nirvana, concerning the famous naked baby photo on their 'Nevermind' album cover.

Spencer Elden, who was photographed as a baby for the album cover, claimed the image caused him permanent harm and violated child sexual abuse laws.

U.S. District Judge Fernando Olguin ruled that the photo is not child pornography. He described it as similar to a family photo of a nude child bathing without any sexual intent.

The lawsuit, which was revived last year by the Ninth Circuit Court, has now been officially dismissed.

Despite his claims, Elden has previously reenacted the photo and embraced the identity of the "Nirvana baby."
