LEE'S SUMMIT, Mo. -- One Missouri suburb wants to raise the tax at one of its grocery stores despite efforts on both sides of the state line to eliminate food tax.

Hy-Vee took the City of Lee's Summit to court on the matter last month and just won. But the fight may not be over; Lee's Summit has filed a notice of appeal.

The debate centers around a development on Highway 291 near Highway 50 known as Oldham Village. According to the lawsuit, Hy-Vee was asked to move its store from SE Ward Road to the new location, but declined.

They'd just completed nearly $10 million in renovations to the existing store. Sitting just over a mile away, the store says it shouldn't be part of a special taxing district. That district could actually be used to bring in a competitor.
