CINCINNATI (WXIX) - The trial for the man accused of murdering a Hamilton County deputy has been pushed back by three months.

Rodney Hinton Jr. will now go on trial April 6 instead of Jan. 12.

The change comes at the request of his attorney, Clyde Bennett II, who said in court Friday morning he would not be ready by January.

Earlier this week, Bennett announced a court-appointed psychologist who examined Hinton, 38, found he suffers from a serious mental illness that impairs his rational judgment.

That makes Hinton ineligible for the death penalty under Ohio law, Bennett said.

The results of his first mental evaluation are set to be revealed in court in December.

Bennett said he plans to file a new plea of not guilty by reason of insanity, but so far has not.
