WASHINGTON — The man who threw a Subway sandwich at federal officers in a viral moment that came to represent opposition to Trump's federal takeover of D.C. is asking a judge to dismiss the charges. He argues that he is being selectively and vindictively prosecuted.
Sean Dunn, a 37-year-old former Department of Justice paralegal, was arrested after he tossed the sandwich at a Customs and Border Patrol officer on Aug. 10. Dunn was initially told in D.C. Superior Court that he wouldn't be prosecuted, but after video of the incident gained traction online, U.S. Attorney for D.C. Jeanine Pirro tried to charge him with felony assault of an officer. When a grand jury refused to indict him, Pirro's office went forward with the misdemeanor simple assault charge he currently faces.
