WILMINGTON, Del. (WATE) — Exit 407: Gateway to Adventure owner and operator Kituwah LLC is suing a co-investor connected to a panned Sports Illustrated Resort, alleging that the co-investor failed to pay an annual financing fee on a $5 million loan.

On Tuesday, Kituwah issued a release about social media posts and discussions regarding the "Sports Illustrated Resorts venture," explaining that it is limited in what it can give information on because of ongoing legal proceedings. The company said allegations circulating are not giving the full picture, and Kituwah has acted proactively to protect the Eastern Band of Cherokee Indian tribe's investment in the resorts, including by starting litigation to hold those who have failed to fulfil their contractual obligations to Kituwah.
