HOUSTON — The man accused of fatally shooting an 11-year-old boy in east Houston in August was back in a courtroom Tuesday morning as attorneys argued over the speed of the legal process.
Julian Guzman was allegedly gunned down as he ran away from Gonzalo Leon Jr.'s home, after authorities said Guzman played a ding-dong ditch prank. The victim and a friend were ringing doorbells in the neighborhood late that night and then running, according to investigators.
Leon Jr. is charged with murder, injury to a child and aggravated assault.
Prosecutors told the court they still anticipate upgrading the case to capital murder, but said the investigation is ongoing.
Leon Jr.'s attorney complained that they are in legal limbo while they wait.
