PORTLAND, Ore. (KOIN) – After the U.S. Court of Appeals for the Ninth Circuit ruled that the Trump administration was within its rights to deploy the Oregon National Guard into Portland last week, Oregon attorneys said the decision was based on false information.

On Thursday, the attorneys sent a letter to the appellate court claiming that the number of officers sent by the Federal Protective Service were incorrectly tallied.

The citation filed on Oct. 23 said, "Plaintiffs write to alert the Court of a material factual error by defendants on which the panel relied to grant a stay pending appeal. Given that reliance, and the gravity of the interests at stake, plaintiffs ask that the panel immediately withdraw its order or, in the alternative, that the en banc court immediately vacate it.
