A three-year courtroom battle over inclusionary zoning might soon come to a head in Pittsburgh — and the controversial policy could be struck down even as city officials consider expanding it.

The Builders’ Association of Metropolitan Pittsburgh filed the suit in 2022 against the city and local officials 10 days after Mayor Ed Gainey expanded inclusionary zoning, which mandates affordable housing for most new projects, into Bloomfield and Polish Hill. The association represents more than 400 builders, realtors, developers, architects and more in Western Pennsylvania.
