The Karnataka High Court has quashed an FIR against a 23-year-old man accused of raping a woman he had met through a dating app , observing that a consensual relationship cannot ordinarily be criminalised.
Justice M Nagaprasanna, while allowing a petition filed by Sampras Anthony , remarked, “A relationship born of mutual volition, even if it founders in disappointment, cannot, save in the clearest of cases, be transmuted into an offence under the criminal law.”
According to the prosecution, the complainant and the accused became acquainted through a dating app and continued their interactions for over a year through photos and chats on Instagram.
