FAIRMONT, W.Va. — A Marion County judge on Tuesday denied a request for an injunction to block the impending sale of the John Manchin Sr. Health Care Center in Fairmont.

Marion County Circuit Judge Matt Delligatti ruled against the injunction request filed by state Sen. Joey Garcia, D-Marion, on behalf of a resident of the state-run facility.

The sale of the center and three others across the state was announced by Gov. Patrick Morrisey in August. The sale of the four facilities is set to generate $140 million for the state.

Garcia's request was filed last Friday. The sale is scheduled to close this Friday.
