LITTLE ROCK, Ark. — After a previous election lawsuit was filed earlier this month, a second is now being filed, but this time around it is for House District 70.

This is now the second election lawsuit filed against Arkansas Secretary of State Cole Jester and Governor Sarah Huckabee Sanders about a special election.

This lawsuit comes after the House representative in the district, Carlton Wing, resigned his position on September 30, 2025.

The question at the center of the lawsuit filed by the Democratic Party of Arkansas has been whether or not the 30,000 people in House District 70 should have representation in the fiscal session that is set to start in April of 2026.

There has also been an argument that points to a special election from 2019 as a precedent.
