The shooting happened on Oct. 13 at the CityBird location downtown. But, this isn't the first time Ferguson has faced charges.
Prosecutors say he used the same gun in a shooting in Northside just two days earlier.
During both incidents, Ferguson was on probation and not allowed to have a gun.
Ferguson and his attorney claim he fired the shot in self defense. His attorney says there is cell phone video of the lead up to the incident taken by the restaurant's manager.
Prosecutors noted that Ferguson has faced charges before, using the same gun in a shooting in Northside j
