LEXINGTON, Ky. (WKYT) - A Central Kentucky family filed a federal lawsuit against ByHeart after their baby contracted infant botulism from the company’s formula.
Hanna Everett of Richmond said her four-month-old, Piper, was constipated, not eating and overall seemed sick.

Once a friend told Everett about the recall, Everett said she rushed Piper to the emergency room.
After five days in the hospital, Piper was released, but will have to undergo feeding and speech therapy.

The lawsuit said the Everett family wants to hold ByHeart responsible for producing contaminated formula, and that the family is asking for financial compensation to cover Piper’s hospital bills and other damages.
