A federal judge ruled Tuesday that Immigration and Customs Enforcement (ICE) agents in Colorado are required to make a probable cause determination on whether someone is a flight risk before arresting them without a warrant, as required by law.
The order is in response to lawsuit brought by several plaintiffs, including two people who were arrested in Grand Junction earlier this year, alleging ICE has been arresting people without properly obtaining a warrant or determining them to be flight risks.
"Mere presence within the United States in violation of United States immigration law is not, by itself, sufficient to conclude that a person is likely to escape before a warrant for arrest can be obtained," Judge R. Brooke Jackson wrote in the order, which partially granted a preliminary inju
