The New Jersey Supreme Court ruled Thursday that prosecutors can use a digital video recorder seized without a warrant as evidence in Paul Caneiro’s trial for the 2018 killings of his brother, sister-in-law, and their two children .
The decision reverses lower court rulings that found the warrantless seizure of the DVR from Caneiro’s garage was not justified because the fire had already been extinguished in that part of the structure.
Prosecutors believe the DVR will show Caneiro disconnecting the security camera system prior to setting his own home ablaze , an act they said was a ruse meant to destroy evidence and mislead homicide investigators as Keith Caneiro’s home burned as well.
