WICHITA, Kan. (KWCH) - The Kansas Supreme Court reversed a murder conviction against a Butler County man. In 2023, the lower court sentenced Kaleb Hogan, 27, to life in prison with a possibility of parole in 25 years. At that time, the jury found that Hogan murdered his three-month-old baby in 2021 by shaking his son or slamming him.

On March 23, 2021, Hogan called 911 to report that his three-month-old son was vomiting and not breathing. The baby later died, according to court documents.

The high court reversed the ruling because the State had submitted evidence of prior child abuse, but the abuse could never clearly be linked to Hogan. At the sentencing in 2023, the State recognized its error, and the judge dropped the child abuse charge because of the error in evidence submission.
