AMARILLO, Texas (KFDA) - A higher court has ordered a new sentencing hearing for a Randall County man currently serving a 25-year sentence for two sex offenses.

A jury found David Allen Dewald guilty of two counts of failure to register as a sex offender in February 2024.

In his sentencing hearing, the State argued the punishment range be increased from that of a third-degree felony to a first-degree felony—five to 99 years imprisonment.

Dewald was then sentenced to 25 years in prison on each count, to be served concurrently.

Dewald filed an appeal challenging his conviction on the grounds that the State had overstepped its boundaries in enhancing the punishment range to that of a first-degree felony.
