After a daylong hearing Friday, Superior Court Justice Michael Gibson reserved his decision in a case involving the removal of homeless people from an encampment at Weber and Victoria streets in Kitchener.
The Region of Waterloo owns the land. Since April, it has deployed outreach workers to work with the homeless residents on the site, offering them alternative spaces in shelters or motel rooms.
Waterloo Region Community Legal Services argued that homeless people living in the encampment would suffer so much by being removed, it would violate their Charter rights.
The legal services organization, representing the encampment residents, had asked the court to halt the removal of residents until the constitutional challenge can be heard and decided later this year.
