A former Sudbury man who assaulted his partner twice over the last nine months – smashing her iPhone during one of the incidents – has escaped a criminal record.

“I sincerely apologize,” Joseph Frawley told Ontario Court Justice Faith Finnestad in Sudbury court. “I deeply regret the impact my actions have had.”

Frawley, 21, who had pleaded guilty to assault, said that he was “an ambitious young man” who will use what happened as a learning experience and do better going forward.

The Crown and defence lawyer Michael Venturi suggested the conditional discharge.

Justice Finnestad also imposed an 18-month probation order that includes the condition that Frawley take treatment as directed, in particular for domestic violence, including the Partner Assault Response progra
