A progressive lawyer warned Wednesday that the Supreme Court has already signaled how it will rule on an important voting rights case.
Marc Elias, founder of the Elias Law Firm, joined progressive YouTuber Brian Tyler Cohen on the show "Democracy Watch" to discuss the case. Elias said the case, which involves Louisiana's election map, could have significant ramifications for the 2026 midterm election.
In the lawsuit, non-Black voters argued that Louisiana lawmakers violated the Voting Rights Act when they redrew their election map and created a district where a candidate of color could win a congressional race. Lawmakers have said politics, not race, was used to redraw the maps.
Even though the Voting Rights Act has been under attack since it became law, Elias said there is a long history of Supreme Court precedent that supports protecting the law.
That being said, Elias warned that four justices have said they support striking down the law. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Amy Coney Barrett have all signaled that they may ignore court precedent in their opinions.
"For the US Supreme Court to decide now somehow it is no longer necessary because times have changed, there's no longer a need for it, or whatever excuse they would have is simply inexcusable," Elias said.
During the last term, the Supreme Court heard arguments in the case in March but did not issue a decision. The fact that they chose to hear the case in October, which marks the beginning of the new term, is a strong signal that they want to decide the case ahead of the midterms, Elias argued.
"This is an enormous deal," Elias said. "It looks like the US Supreme Court may be trying to not only undermine the Voting Rights Act, potentially going so far as to overturn section two of the Voting Rights Act, but they are trying to do it on an expedited schedule, presumably because they know the 2026 midterms stand in front of all of us."
