BAKERSFIELD, Calif. (KGET) -- The couple accused of torturing and killing 8-year-old Genesis Mata had their preliminary hearing delayed to October after defense counsel on Thursday said they weren't close to being ready.

Ray Mata Jr. and Graciela Bustamonte are now set for a preliminary hearing Oct. 16. If it goes forward as scheduled, a judge will decide whether there's enough evidence for the case to proceed.

Prosecutor Eric Smith, who appeared on behalf of Leanne Wilder, the attorney assigned to the case, told the court he was under the impression everyone was ready for the hearing.

But Gary Turnbull, Bustamonte's attorney, said the discovery process was "nowhere near" completed. Deputy Public Defender Sunny Gallo, representing Mata, also said she needed more time.
