CHARLESTON, S.C. —

A South Carolina case regarding transgender student's ability to use the bathroom of the gender he identifies as could end up in the nation's highest court.

The lawsuit was filed in November 2024 after the student, who is referred to as "John Doe" in court documents, was not allowed to use the boys' bathroom throughout the 2024-2025 school year, when the plaintiff was in middle school.

This week, the Fourth Circuit Court of Appeals blocked the judge's decision that prevented the teen from using the boys' bathroom as he enters high school this year.

The court's decision means neither the state nor Berkeley County can prevent the transgender high-school student from using the bathroom that aligns with the gender the student identifies as.
