LOUISVILLE, Ky. (WAVE) - A recent motion could change the scope of a wrongful death lawsuit involving a crash that killed a 10-year-old boy in Oldham County.

Jake Luxemburger died in a wreck that began as a police pursuit on Sept 16, 2023.

Police said the chase began when Kentucky State Police Trooper Zachary Napier tried to pull over a car that didn’t stop, and Napier pursued. The car eventually exited the interstate and crashed into a white SUV that had Jake Luxemburger and his grandmother inside. Jake died in the crash, and his grandmother was severely injured.

Tymetrius Walter was arrested for the crash and charged with murder.

In the original complaint, which was filed on behalf of Jake’s parents and grandmother, Walter and Napier were both named as defendants.
