MINOT, ND (KXNET) — A Surrey man charged in the 2023 Christmas Eve shooting death of Air National Guardsman Nicholas Van Pelt is expected to take a plea deal that would reduce the most significant charge against him.

Prosecutors said 41-year-old Daniel Breijo, a former Department of Homeland Security agent, plans to plead guilty to manslaughter, aggravated assault, and reckless endangerment.

He was originally charged with Class AA murder, aggravated assault, reckless endangerment, and terrorizing. He was also charged with assault on a peace officer. However, that charge was dismissed last year.

The case stems from a shooting at a southwest Minot apartment where officers said they responded to a report of gunshots and a woman screaming.
