Appeals Court Finds City Protected by Recreational Property Act in Tourist’s Lawsuit
The City of Savannah has won its appeal in a “trip and fall” lawsuit brought by a tourist, Gloria McLamb, who was injured after she tripped on a raised paver in the city’s historic district. The Georgia Court of Appeals reversed a lower court’s decision, ruling that the city is protected from liability under the Georgia Recreational Property Act (RPA).
In August 2025, the court issued its decision in the case of The Mayor and Aldermen of the City of Savannah v. McLamb . The ruling overturned the trial court’s denial of summary judgment for the city, which had sought to have the case dismissed.
