A Norfolk Superior Court judge has struck down an effort by Brian Walshe's legal team to have the most serious charge the Cohasset, Massachusetts, man faces in the disappearance and alleged murder of his wife thrown out.

Walshe's motion to dismiss his indictment for first-degree murder was denied by Judge Diane Freniere in a decision dated Tuesday.

The defense attorneys representing Walshe, Larry Tipton and Kelli Porges, argued that prosecutors did not present sufficient evidence to support the first-degree murder indictment. Freniere found, though, that the Commonwealth did establish enough probable cause in their case to support the indictment.
