LOUISVILLE, Ky. (WAVE) - The Indiana Court of Appeals has denied former Clark County Councilmember John Miller’s challenge to the conflict of interest case against him.

Special Prosecutor Ric Hertel charged Miller with breaking Indiana’s conflict of interest law when he accepted meals, gifts, and travel from Jamey Noel while voting to fund several contract extensions between Noel’s New Chapel EMS and Clark County.

Miller’s defense lawyer, Bart Betteau, argued the Special Prosecutor erred in his conflict of interest charge.

Betteau argued Miller could only violate the conflict of interest law if he was a direct party to the contract between New Chapel EMS and Clark County.
