Ex-Decatur Police Officer Mac Bailey Marquette now hoping the Alabama Supreme Court will drop his murder charge in the killing of Steve Perkins.
Marquette's legal team on Wednesday petitioned the state's highest court to issue a writ of mandamus after the state Court of Criminal Appeals refused to do that.
Marquette is accused of shooting and killing Perkins in his front yard in September 2023 during a vehicle repossession. Marquette says he shot Perkins in the act of performing his job as a police officer and therefore cannot be charged with murder.
If granted by the court, the writ essentially serves as an order for the lower court to change its decision.
